General Terms and Conditions

Active since: October 1, 2022

The following terms and conditions govern the contractual relationship between GAngel and its customers, both in regards for people using the service free of charge and as a paying member, regardless of whether you access GAngel via its website or mobile apps.

Please note that for contractual relationships established via third-party providers such as Apple or Google, different regulations apply in some cases. Functions might differ whether the service is accessed via the website or app.

Persons who have not yet reached the age of 18 may not use this service. The use of this service for commercial purposes is also not allowed.

1 Subject of the contract
1.1 During the term of the contract, GAngel offers its customers access to an online database that enables them to get to access content and also see other profiles (hereinafter "GAngel service"). The GAngel service can be accessed exclusively via mobile apps for iOS and Android devices or via the website and includes both free and paid services.

1.2 The online database provided by GAngel contains content and so-called profiles of other people, which are provided by the registered customers with their own content (also referred to as "data"). What data is collected in this context and how this data is visible to other customers is also set out in the data protection notices (see section 4.1).

1.3 GAngel offers its service worldwide. The respective profile of what the customer provides with own data can be visible in all countries, irrespective of the regional website or regional mobile app through which the customer has registered.

1.4 The subject of the contract with GAngel is a social network that offers its customers the opportunity to access content provided by GAngel and present their own content and interact with other customers.

2 Access & Conclusion of contract
2.1 Access to the use of the GAngel service requires registration. For this purpose, the customer needs an e-mail address and a password chosen by the customer. A profile ID (user name) and a "password" are automatically created for the customer by GAngel after registration and sent to the customer by e-mail. Other Login options are provided such as Facebook Login and Apple Login or the login with a phone number. The customer can login with their account credentials from these services. When signing up by phone number, the customer should ensure its validity to receive codes via SMS text messages e.g. the initial login password.

2.2 With the registration initially a basically free contractual relationship between GAngel and the registered customer (also called "basic membership").

2.3 In order to use the GAngel service, it is necessary provide of personal data such as the first name, date of birth. Only with a registered account, the profile is able to access the data base. Some of these details can be changed after profile creation only with the help of GAngel customer service.

2.4 GAngel offers the customer various chargeable services. This includes in particular the "Premium Membership". The customer can choose in the ordering process between different initial durations. Credit for the activation of individual profiles is provided in the basic membership both free of charge and subject to a charge, insofar as this feature is available. The customer will be informed again about the content of the respective chargeable service, the prices and the terms of payment before concluding a chargeable contractual relationship. By pressing the button “Buy Now", the customer declares that he wishes to conclude a contract for the chargeable services selected by him.

2.5 GAngel also enables its customers to use paid services via the payment platforms Apple and Google Play (so-called "in-app purchases"). The third-party providers have prescribed sets of rules for the conclusion of the contract, the payment as well as the termination of the contractual relationship, which the customer accepts via the terms of use of the third-party provider and over which GAngel has no influence. If the customer decides to conclude a contract with GAngel via the third party provider, it is an obligation of the customer to comply with the regulations prescribed in the terms of use of the third party provider for the conclusion, payment and termination of contracts. In case of any contradictions between the regulations of the third party provider and these General Terms and Conditions of GAngel, the regulations of the third party provider take precedence. In particular, the customer will be asked by the third party provider to confirm his purchase to him. The payment method is then the one that the customer has agreed with the third-party provider (e.g. the customer pays at Apple via the payment method stored in his Apple ID). If the customer wishes to change or terminate an in-app purchased Premium Membership, it is necessary to do so via his account with the third-party provider, log in there and follow the third-party provider's instructions on the termination, revocation or cancellation. Any refunds will be made either in the relationship of the third party provider with the customer or in the relationship of the customer with GAngel, depending on the rules and regulations of the third party provider.

3 Chargeable and Free of Charge Services
GAngel offers free services and the option to upgrade the account to get extended access to content and further people.

4 Data protection notices & Security
4.1 Further information on how personal data is processed and what rights the customer has in relation to data protection can be found in the data protection notices.

4.2 GAngel is constantly striving to protect its customers from harassment such as hacker attacks, spam or romance scamming. For this purpose, GAngel has developed numerous technical and organizational standards to detect violations of the usage guidelines. GAngel is in this respect also entitled to bring suitable filter or validation software to use. An obligation to use such software does not exist. It is the responsibility of the customer to familiarize himself with the security tips of GAngel before using the GAngel services. The customer should also forward problematic content or behavior to GAngel via the the respective customer service representatives.

4.3 GAngel is not obligated to carry messages if there is a suspicion that they violate the usage guidelines and are therefore abusive. In particular, there is no obligation to transport messages that are unsolicited advertising messages or there is a corresponding suspicion.

5 Termination & Extension
5.1 The customer has the right to terminate the contract for the free basic membership with immediate effect at any time. The termination of the basic membership is effective by deleting the profile in the app or website and the confirmation of this process by entering the personal password.

5.2 The customer has the right to terminate the contract for the paid premium membership properly at the end of the initial term. The ordinary termination of the paid Premium Membership shall only take effect at the end of the agreed initial term (and as such is not refundable). The period for the ordinary termination of the paid premium membership at the end of the initial term results for the order via GAngel from the product-related contract contents, which are confirmed by the customer during the ordering process on the order page. When ordering a premium membership, the customer is also informed of the cancellation period in the order confirmation by e-mail. When ordering a premium membership via third-parties (App Store or Google Play) it is up to the customer to check auto-renewals and membership durations in their phone settings and to cancel auto renewals before expiration dates to avoid any unwanted costs.

5.3 If the customer has concluded his Premium Membership via third-party providers such as Apple or Google Play, the termination of the contractual relationship is governed by what has been said in section 2.5. If the customer wishes to terminate his in-app purchased Premium Membership, it is necessary to do so via his account with the third party provider, log in there and follow the third party provider's instructions for termination. Details on how to terminate a Premium Membership via third-party providers can be found here for Apple and here for Google Play. The ordinary termination of the paid membership via third-party providers also does not automatically lead to the termination of the basic membership.

5.4 When an order is placed via third-parties for GAngel, the contract for the paid premium membership can be auto-renewal and will be automatically extended for an indefinite period of time, unless the customer terminates his contract in accordance at the end of the initial term in compliance with the notice period. After the contract has been extended, payment shall be made at the agreed price monthly in advance, whereby the Premium Membership can be terminated at any time with one month's notice. When ordering a Premium Membership, the customer will also be informed immediately before submitting his order and in the order confirmation about the circumstance and conditions of a possible extension in case of untimely termination.

5.5 In the event that the Premium Membership is concluded via third-party providers such as Apple or Google Play, the conditions of any automatic renewal shall result from the respective offer, the regulations in the third-party provider's account and the order confirmation received by the customer upon conclusion of the contract.

5.6 Termination of the paid membership does not automatically lead to termination of the free membership. In this case, the procedure set forth in Section 5.1 shall apply.

6 Liability of GAngel
6.1 GAngel can not be held responsible for incorrect information in the applications of customers. It follows that GAngel can not assume any liability for the accuracy of the results of the GAngel questionnaire as well as the contents of the portrait of the partnership personality created on its basis.

6.2 GAngel owes only the provision of IT services for the automatic mediation of contacts, not the success. GAngel provides only the technical device that generally enables a contact.

6.3 GAngel also assumes no liability for the possible misuse of information. It is possible that customers use the GAngel service in an inadmissible or unlawful manner despite the prohibition. For such inadmissible or illegal use, any liability of GAngel is excluded. GAngel is also not liable for the misuse of data and information that the customers themselves have made available to third parties.

6.4 GAngel does not guarantee the proper operation at all times or the uninterrupted usability or accessibility of the service. In particular, GAngel is not liable for disruptions in the quality of access to the Service due to force majeure or events for which GAngel is not responsible. Furthermore, GAngel is not liable for the unauthorized knowledge of third parties of personal data of customers (eg by unauthorized access by "hackers" to the database).

7 Responsibility and obligations of the customer
7.1 The customer is obliged to make all payments due to GAngel or the third-party providers (see in this respect section 2.5) on time. If the customer is culpably in arrears with more than two consecutive partial amounts (if partial payments are agreed), all outstanding payment claims up to the next possible termination date are due immediately. In the event of a delay in payment, GAngel is entitled to temporarily block access to the GAngel service.

7.2 The customer is solely responsible for the content of his registration and thus for the information he provides about himself. The customer assures that the data provided is true and describes him personally. False information provided intentionally and/or fraudulently or the impersonation of a different or fictitious identity may also result in civil action.

7.3 The customer further assures that he uses the GAngel service exclusively for private purposes, has no business intentions and does not use the data of other members entrusted to him for commercial or advertising purposes. In particular, it is not permitted to systematically read the contents of other users (e.g. by means of a program or by mere copying) in order to use them outside the GAngel service. In this respect, the use of computer programs for the automatic reading of files, such as crawlers, is also prohibited.

7.4 The customer agrees to hold GAngel harmless from any kind of lawsuits, damages, losses or claims that may arise from his registration and / or participation in this service, provided that the customer has acted culpably. This applies in particular to damages due to defamation, insult, violation of personal rights, due to the failure of services for other customers, a violation of these terms and conditions, due to the violation of intellectual property or other rights. The claim for reimbursement of expenses shall be limited in amount to the necessary expenses or the expenses required for a specific purpose.

7.5 The customer is obligated to treat e-mails and other messages confidentially and not to make them accessible to third parties without the consent of their author or without good cause. The same applies to names, telephone and fax numbers, residential addresses, e-mail addresses and/or URLs or other personal data of other customers.

7.6 The customer agrees to notify GAngel immediately if he is no longer interested in receiving the service because of the conclusion of a partnership or for other reasons or if he no longer wants to be available to other customers as a receiver.

7.7 The customer is required to retrieve the messages received for him as well as the data of his profile at regular and reasonable intervals and, if necessary, to archive them on his own computer or other storage media. GAngel is entitled to delete the messages stored in the account of the customer in each case after twelve months after sending or receiving without further inquiry. All data within the scope of a free membership will be automatically deleted after twenty-four months after the last login of the customer.

7.8 Furthermore, each Customer undertakes not to misuse the Service, in particular:
· Not to disseminate any immoral, obscene, pornographic or right-wing/left-wing radical content or photos in the profile or video chat;
· not to distribute any defamatory, offensive or otherwise unlawful material or information through the Service;
· not to threaten or harass other persons or violate the rights (including personal rights) of third parties;
· not to upload data containing a virus (infected software) or software or other material protected by copyright, unless the Customer has the rights thereto or the necessary consents;
· not to use the Service in a way that adversely affects the availability of the offers to other customers;
· not to intercept or attempt to intercept any emails / messages;
· Not to send e-mails / messages (including video chat messages) to customers for any purpose other than communication and, in particular, not to advertise or offer goods or services to other customers (except in cases where this is expressly permitted by GAngel);
· not to send e-mails / messages (including video chat messages) to customers with an unreasonably high or harassing frequency, as well as to send initial messages to an unreasonably high number of customers at short intervals; in this regard, GAngel reserves the right to set certain limits by technical means that are necessary to ensure the security and integrity of the platform;
· not to create message texts by "copy and paste" function or to send chain letters;
· not to send messages that serve a commercial purpose;
· to maintain the required distance in initial messages and contact requests and therefore not to provide them with contact details such as full names, addresses, telephone or fax numbers, e-mail addresses, etc;
· not to make initial messages or contact requests unreasonably short or long; GAngel reserves the right to technically determine certain minimum and maximum lengths of messages by means of technical specifications.

7.9 Failure to comply with any of the behavioral obligations set out in paragraphs 7.1 - 7.5 and 7.8 may result in the following sanctions:

· Request for a statement in the event of suspected breaches of contract / law, blocking of use until facts are clarified (especially in the event of multiple complaints from other customers),
· warning of a customer, restriction / limitation in the use of applications in the GAngel service, partial deletion of content.

Failure to comply with the behavioral obligations set out in sections 7.1 - 7.5 and 7.8 may also lead to immediate termination of the user agreement as well as civil and criminal consequences for the customer himself. The blocking of an access does not change the customer's obligation to pay for ordered services.

8 Communication
GAngel is an online service. As such, GAngel communicates with its customers either via the in-app messenger system when logged in or via email (e.g. support, sending partner proposals, reminders). Telephone, fax and mail by post are excluded from communication between the company and the user. For clear authentication and protection against misuse, your messages should contain one the following detail so that we can assign you to your account, depending what applies to you: E-mail address, Facebook email address, Apple ID email address, or phone number registered with. GAngel sends to all of its registered users unpersonalized messages of informational and promotional content. This can be within the GAngel platform (GAngel News) or to the linked Email address or phone number in the for of SMS messages. Users can specify the types of messages they want to receive in their settings.

9 Rights of Use and Copyrights
In relation to you, GAngel is the sole legal owner of the reproduction, distribution, processing and all copyrights as well as the right of intangible transmission and reproduction of the GAngel website and the individual content contained therein. The use of all programs and the content, materials, brand and trade names contained therein is only permitted for the purposes stated in these terms and conditions.

This website and the GAngel services may contain links to sites that are not affiliated with GAngel. The inclusion of a link on this website does not imply our endorsement of the linked site. If you decide to access linked third-party websites, you do so at your own risk. Despite careful control of the content, we don’t take any liability for the content of external links. The operators of linked pages are solely responsible for their content.

11 Applicable law, alternative dispute resolution
This contract is subject to the law of the People’s Republic of China in its Special Administrative Region of Hong Kong. GAngel does not participate in dispute settlement procedures before consumer arbitration boards. In this respect, there is no legal obligation.

12 Disclaimers
GAngel is not responsible for any incorrect or inaccurate content posted on the website or in connection with the service, regardless of whether it is caused by users of the website, members or by devices or programs connected to the service or used in this service.

GAngel is not responsible for the online or offline behavior of a user of the website or a member of the service.

GAngel is not responsible for errors, interruptions, deletions, defects, operating or transmission delays, communication line failure, theft or destruction, or unauthorized access to or changes in user or member communications.

GAngel is not responsible for problems or technical malfunctions in telephone networks or lines, online computer systems, servers or providers, computer equipment, software, email or player failure due to technical problems or traffic jams on the Internet or on websites or a combination thereof, including injuries or damage to users and / or members or someone else's computer related to or resulting from participation or downloading of materials related to the website and / or service.

In no event will GAngel be responsible for any loss or damage, including personal injury or death, arising from the use of the website or the service, content published on the website or transmitted to members, or interactions or contacts between users of the website, whether online or offline.

13 Additional
13.1 GAngel is entitled to commission third service providers and vicarious agents to provide parts or the entire range of services.
13.2 Should a part of the contract or the general terms and conditions become or will be ineffective or should the contract be incomplete, the remaining content of the contract will not be affected. The statutory provisions also apply.
13.3 The contract language is English.
13.4 As part of the conclusion of the contract, the contract text is not automatically saved by GAngel. The customer is therefore obliged to save the contractual text that is valid at the time of the conclusion of the contract and is accessible on the GAngel website on his hard drive or to archive it in any other way.
This contract can be change by GAngel at any time. If you are a GAngel member (“basic” or “premium”) at the time of any change, the revised terms will be effective upon posting on the website and your use of the GAngel services. 2. Collection, processing and use of personal data
Personal data is any information relating to an identified or identifiable natural person (e.g. name, address, telephone number, date of birth or e-mail address).

When we process personal data, this means that we collect, store, use, transmit or delete data.

GAngel collects and processes your personal data exclusively in the following cases:
· When you visit us on our website without being a member.
· When you contact us by direct means.
· When you install our GAngel app.
· When you conclude a free or paid membership with GAngel and subsequently use GAngel.

The provision of your personal data in the context of the conclusion and existence of the contractual relationship with GAngel is voluntary. For the membership with GAngel, however, it is necessary that you provide personal data of special categories (e.g. your gender or data of sexual orientation or other personal data). Also, the use of the GAngel service requires that your profile information and your matching ratings to other GAngel members are visible to them.

In this regard, please also note that we offer the GAngel service in many different countries and the information contained in your profile is visible to our members in all of these countries. You can search for your partner in any of these countries.

If you do not want GAngel to process personal data or parts thereof from you, GAngel can not provide its service as stated in the terms and conditions and you cannot use GAngel.

2.1 Data processing
If you install the GAngel app via an app store operator as a third-party provider (e.g. Google or Apple), you may have to conclude a usage agreement with the respective app store operator regarding access to its portal. This access requires a valid account with the app store operator as well as a corresponding end device (e.g. smartphone) and GAngel has no influence on the data processing in this context. The responsible party in this respect is solely the app store operator of the respective app platform. If necessary, please inform yourself directly with the app store operator (third-party provider) about its data processing. In this case, GAngel is only the responsible party in the context of the use of the GAngel app.

2.2 What data does GAngel collect from its members to fulfill the contractual relationship?
In order for GAngel to provide the services described in more detail in the General Terms and Conditions, it is necessary to process the personal data described below, which the user (also referred to as GAngel member) provides, among other things, as part of the registration process, the conclusion of a basic membership or a premium membership.

2.3 Registration process
During the registration process, which is initially free of charge (conclusion of the so-called "basic membership"), the user (or also referred to as "basic member") is requested to provide certain minimum information, without which the registration cannot be completed. These data are:

· Gender and searched gender (the searched gender is a date of sexual orientation and therefore a special category personal data).
· E-mail address or phone number
· Password chosen by the user

If you have chosen a login via third party providers such as Facebook or Apple, you do not provide an email address/ phone number or password within the registration process. The respective access to GAngel then takes place via the e-mail address and password selected by the user (so-called access data) or alternatively via the login data of the third-party provider.

2.4 When registering via Apple ("Register with Apple")
GAngel offers you the option to register via your Apple user account. If you make use of this, we receive the data required for registration from Apple. In this respect, a data transfer takes place. With Apple, you have the option of sharing your email address stored there with GAngel or hiding it. If you hide your e-mail address, we receive a unique, randomly generated e-mail address from Apple for the creation and use of your GAngel account. Our communications are sent by us to this email address and automatically forwarded by Apple to your email address on file with Apple, unless you have disabled GAngel email forwarding.

We have no influence on the scope of the data collected by Apple by means of the Apple login. If you do not want Apple to collect data about you in connection with your use of our online service and use it for its own purposes, you should not use the Apple login.

You can disconnect your GAngel account from your Apple account at any time on our website. In this case, we require the access data described above from you.

2.5 When registering via Facebook ("Facebook Login")
GAngel uses the "Log in with Facebook" business tool with the additional "Data Access Function". Through this, GAngel offers you the possibility to register via your Facebook account. If you make use of the function, we receive the following authentication data from Facebook for the registration: Your e-mail address stored there, your profile name and your profile picture. GAngel stores and processes only the e-mail address. In this respect, a data transfer takes place. Your Facebook profile name and profile picture are not stored or processed by us, but are automatically deleted.

If you use the Facebook login on our website or app, Facebook will also collect data through third-party scripts, process it for Facebook Analytics purposes or pass it on to third parties. . The Facebook privacy notices explain which data can be collected by means of the Facebook login. This includes data about your device, your use of GAngel, the websites you have visited, and the advertisements you have viewed. Unfortunately, it is not technically possible for GAngel to refuse this processing. If you do not want Facebook to collect data about you in connection with your use of our online offer and use it for its own purposes, you should not use the Facebook login.

You can disconnect your GAngel account from your Facebook account at any time on our website. In this case, we need the access data described above from you.

2.6 When registering via phone number (“Cell phone login”)
GAngel offers the option of specifying the cell phone number for a so-called cell phone login. People can sign up using their cell phone number. To fully function, the users have to agree to receive text messages (SMS) from GAngel. A confirmation code will be sent to the cell phone number they use after the user has given consent.
GAngel may send to this phone number important messages regarding the user’s GAngel account and its promotions and services. GAngel won’t share this phone number with any third party. If a user does not want to sign-up with his cell phone number, he should choose a different sign-up method on the GAngel app or website xxx.com.

2.7 Required information within the scope of a basic membership
In the personality test that follows registration, the following information is requested, among other things

Profile Picture

Furthermore, GAngel gives its users the option to provide additional information in order to provide better services, preferences, to its members such as personal values, preferences, appearance and other characteristics.
Photos can also be uploaded, and these photos are made available to other members in recognizable form in the profile next to the member's first name.

All data of the GAngel profile is visible on app for other registered users. In particular, the first name, age, place of residence, and interests of the customer are visible.

2.8 Conclusion of a premium membership
If the user (hereinafter also referred to as "premium member") decides to conclude a paid service of GAngel (so-called "premium membership") the purchase goes through third-party applications and providers (e.g. Google or Apple). The terms of use of these app platform operators can be found which personal data are processed by them in the course of the purchase process. GAngel does not process any payment and billing data in this respect.

2.9 Communication with members among themselves, communication with customer service
GAngel stores member communications that take place via the GAngel platform, as well as communications with customer service. Members' communication with each other when logged in is encrypted.

Please note that in principle, communication between GAngel and you will only take place via the e-mail address or phone number registered with GAngel or when you reach out to our support team to the email address you wrote from.

2.10 Promotional Messages
With the conclusion of the free basic membership, you provide your e-mail address or phone number upon registration or we receive this from Apple / Facebook (in the case of registration made via this). This e-mail address or any new e-mail addresses subsequently provided by you will be used to send promotional e-mails for the free and paid products of GAngel, without any consent on your part being required.

On the GAngel website, you also have the option of subscribing to a free newsletter by clicking on a checkbox.

Furthermore, during your GAngel membership you will receive e-mails with personalized or individualized advice, which should enable you to make the best possible use of the GAngel products.

Promotional e-mails (including newsletters and guides) are transport encrypted, provided that your mail provider supports the "Transport Layer Security" (TLS) transport encryption.

If you no longer wish to receive promotional e-mails, newsletters or individualized advice from GAngel, please contact our support at support@gangel.org

2.11 Push messages
If your mobile device allows it, you will receive so-called push messages from us when using the GAngel app, even if you are not currently using this app. These are messages that we send you as part of the performance of the contract, but also promotional information.

You can adjust or prevent the receipt of push messages at any time via the device settings of your mobile device or in the GAngel app.

2.12 What data does GAngel collect when using the website?
Each time the GAngel website is accessed, usage data of the respective website visitors - unless otherwise indicated below, even if they are not GAngel members - is transmitted by the respective Internet browser and stored in log files, so-called server log files. These data are:

· Information about the browser type and the Internet service provider of the user and the operating system used (e.g. Windows 7, Apple OS, etc.).
· IP address (Internet Protocol address) of the accessing computer, tablet or smartphone (In this context, the IP address is also compared with a geo-database and the origin or the country, state and city of the user is determined. In this context, GAngel uses, among others, MaxMind (see explanations below)).
· Name of the page accessed
· date and time of the retrieval
· the referrer URL (origin URL) from which the user came to the retrieved page
· Amount of data transferred
· Status message about whether the retrieval was successful
· Session identification number (session ID)
· Session participant pseudonym
· User ID (profile ID) on the GAngel platform (only from GAngel members)
· Screen resolution used

In the so-called login records, the user ID on the GAngel platform is also stored each time the GAngel member logs into the network.

In addition to the previously mentioned data, cookies or pseudonymous IDs (such as user ID, ad ID, if applicable) may be stored on your terminal device during or even after your visit to our online offers when using the GAngel website. You can find more information in this context in our cookies & tracking instructions.

2.13 What data does GAngel collect when using the GAngel app?
Each time the GAngel app is called up by the user's end device, GAngel automatically collects data and information from the operating system of the calling device. This includes, among other things, the storage of the IP address.

Usage data
Each time the GAngel app is accessed, usage data of the respective app user is stored. These data are:

· The operating system used and, if applicable, the browser type.
· Current language setting of the smartphone
· Information about the user's Internet service provider
· IP address (Internet protocol address) of the accessing computer

Login data
In the so-called login data records, the following usage data is stored each time the GAngel member logs into the network:


· Date and time of login
· User ID on the GAngel platform (e-mail address)
· IP address (Internet protocol address)
· Device ID (e.g. UDID) to identify your device(s) as part of a secure authentication process (Secure Authentification).
In addition to the previously mentioned data, pseudonymous IDs (such as User ID, Ad ID, if applicable) may be stored on your end device during or even after your visit when using the GAngel app. You can find more information in this context in our cookies & tracking instructions.

GPS data when using the GAngel app
When using the app, the location data of the device is accessed at this moment (GPS, possibly WLAN information, and device ID). This information is used to determine the user's location so that he or she can set a suitable search radius and view members nearby.

3. Processing purposes

GAngel processes the personal data of its users for the following purposes. If the data processing is based on the legal basis of a legitimate interest, we will subsequently also explain our legitimate interest in the data processing:

To provide the GAngel platform and thus to fulfill the services described in the General Terms and Conditions or, in the case of the forum, in the Terms of Use. This includes in particular:


· Provision of our website for non-registered users;
· Provision and use of our website and app for registered GAngel members;
· Providing a contact option and answering inquiries via the platform;
· Enabling the conclusion of a contract, including invoicing;
· Sending emails and/or push messages with matches or other messages relevant to the contract.(Legal basis of the processing is the performance of the contract with you. Legal basis in some cases is also your consent. Legal basis is also our legal obligation and legitimate interest to provide customer service and improve the customer experience).
· To provide a login via the GAngel platform, the Facebook login, the Apple login or the GAngel forum. (Legal basis of the processing is the fulfillment of our contract).
· For abuse prevention and defense. GAngel collects, processes and uses personal data as well as geodata, which are collected in connection with your registration and the completion of the GAngel personality test and/or the GAngel profile, for an automated check whether there are indications or data for an abuse of GAngel. The data is stored in a database and compared with empirical values. If the automated processing results in a suspicion of misuse, a GAngel employee checks the rating and the underlying indications as well as any free text information and the stored profile photos. GAngel also provides its members with a function called "Report profile" and carries out checks of profiles by customer service employees in the event of contract violations reported by other members. Furthermore, GAngel uses the voluntary provision of the cell phone number to carry out a mobile phone-based identity comparison as part of a so-called ID check. (Legal basis is the legitimate interest of GAngel and the GAngel members that the GAngel service is not abused for contractual and / or illegal acts of third parties. In doing so, we also fulfill our legal obligation in the area of data security to ensure system security and the detection and tracking of unauthorized access attempts or accesses).
· For securing your remuneration obligations from the contractual relationship in the event of default (this only applies to the purchase of Premium Membership via GAngel). If you do not settle outstanding invoices / partial payments despite repeated reminders, we will transmit the data required for the implementation of a collection procedure to a collection service provider for the purpose of trustee collection. Insofar as disputed claims arise, we also transmit necessary data to our payment service providers for the assertion of our rights (e.g. in the context of conflict resolution for chargebacks). (In addition to the fulfillment of the contractual relationship, the legal basis is also GAngel's legitimate interest in the payment of the contractually agreed remuneration).
· For the protection and defense of our rights and the fulfillment of legal obligations. (Legal basis is our legitimate interest in asserting and defending our rights).
· For self-promotion through promotional emails and/or push messages, newsletters, surveys and individualized guides.
· For compliance with statutory retention obligations and other legal or statutory obligations and provisions (e.g. in connection with tax audits, official or court orders to provide information and other orders). (Legal basis is the fulfillment of our legal obligations).
· For other communication purposes in the context of inquiries. (Legal basis may be a pre-contractual legal relationship or a legal obligation).
· To publish your love story (success story) on the GAngel website and, if applicable, in other media. (Legal basis is your consent).

4. Disclosure of data to third parties & service providers
As a matter of principle, GAngel will only pass on your personal data to third parties if this is necessary for the performance of the contract, if we or the third party have a legitimate interest in the transfer, if you have given your consent for this or if this is necessary for the fulfillment of a legal obligation. If personal data is transferred to third parties on the basis of a legitimate interest, we explain our legitimate interest in these data protection provisions.

In addition, personal data may be transferred to third parties:

· to service providers, insofar as the data is necessary for the execution of a contract processing agreement with us;
· if applicable, to providers of marketing tracking technologies and analysis tools (for more information on this, please see our Cookies & Tracking Notice);
· if we should be obliged to do so in individual cases due to legal requirements or by enforceable official or court order;
· in connection with legal disputes (vis-à-vis courts or our attorneys), debt collection cases or audits (vis-à-vis auditors);
· in connection with possible criminal acts to the competent investigating authorities;
· in the event of a sale of the business (to the purchaser).
Insofar as data may be transmitted to other third parties on a regular basis, this will be explained in these data protection provisions or in our cookies & tracking notes. In the case of transmission based on consent, the explanation may also be provided when consent is obtained.

Service providers

GAngel reserves the right to use service providers for the collection or processing of personal data. Service providers receive from GAngel only the personal data that they need for their specific activities.

GAngel uses - to the extent that service providers are not already named in this Privacy Policy or in our Cookies & Tracking Policy - service providers for sending e-mails, push messages and newsletters to members, among other things. Furthermore, service providers provide GAngel with server capacity. If you have purchased the GAngel Premium Membership through GAngel, external payment services and service providers support GAngel in processing payments and in the event of collection. GAngel does not collect payment information, but instead works with payment providers and third-parties. Payment service providers collect this data themselves under their own responsibility. In this respect, the privacy policy of the respective payment service provider applies.

Service providers are usually involved as so-called order processors, which may process personal data of users of this online service. Transmitted to GAngel is only an order ID or equivalent.

Your personal data may also be passed on to third parties (jointly or solely with us) responsible parties, or processors, who are based in non-EU/EEA countries. In this case, we ensure before the transfer that either an adequate level of data protection exists at the recipient (e.g. based on an adequacy decision of the EU Commission for the respective country pursuant to Article 45 of the GDPR or the agreement of so-called standard contractual clauses of the European Union with the recipient pursuant to Article 46 of the GDPR using additional technical and organizational protection measures) or that there is sufficient consent from our users.

5. How do we protect your data?
GAngel uses various security measures, such as state-of-the-art encryption and authentication tools, to protect the security, integrity and availability of the personal data of its customers and users. In particular, these are the following measures:

· Strict criteria for authorization to access your data and 2-factor authentication,
· Storage of confidential data in encrypted form,
· Firewall protection of IT systems to protect against unauthorized access,
· Permanent monitoring of access to IT systems to detect and prevent misuse of personal data.

6. Storage of data
We store your data for as long as is necessary for the provision of our online services and the associated services or we have a legitimate interest in the continued storage. In all other cases, we will delete your personal data, with the exception of data that we must retain in order to comply with contractual or legal (e.g. tax or commercial) security periods (e.g. blacklisted users).

We store data that is subject to a retention period until the period expires.

The following applies to basic members: You can revoke the storage of the personal data contained in your profile at any time with effect for the future. You can also delete your profile data yourself.

For premium members applies: The personal data of GAngel premium members are generally stored for the duration of the contractual relationship. If you ask us to do so, we will delete your data, unless there is a legal obligation to retain this data.

The uninstallation of the GAngel app on your end device does not lead to the deletion of the data in your profile. The statements just made about the deletion of basic member or premium member data apply here.

Log files are stored by GAngel for 90 days and then deleted.

If a user has been blacklisted due to the performance of illegal activities that causes harm to our users, we will store that data for up to 5 years to protect our members and prevent the person from further sign-ups in the future.

7. Cookies & Tracking
This online service uses cookies. In addition to the description of the individual cookies, we have also listed the purpose of use and other important information at this point. Cookies are small text files that are sent when you visit a website and stored in the user's browser. If the corresponding website is called up again, the user's browser sends back the content of the cookies and thus enables the user to be recognized. 8. Right of information & deletion

You have the right to request information from GAngel as to whether we are processing personal data relating to you. In addition, you also have the right to information about this personal data as well as information about the category of data that is stored, the purpose of processing, any recipients, the storage period and the data subject rights to which you are entitled. If your data is incorrect or incomplete, you may request that your data be corrected or completed. If we have passed on your data to third parties, we will inform them of the correction, insofar as this is required by law.

Your right to deletion

You may, if the legal requirements are met, request that we delete your personal data without delay. This is particularly the case if

· Your personal data is no longer required for the purposes for which it was collected;
· the legal basis for the processing was exclusively your consent and you have revoked it;
· you have objected to processing for advertising purposes ("advertising objection");
· you have objected to processing on the legal basis of weighing interests on personal grounds and we cannot demonstrate that there are overriding legitimate grounds for processing;
· your personal data has been processed unlawfully; or
· Your personal data must be erased to comply with legal requirements.

Please note that your right to erasure is subject to limitations. For example, we do not have to or are not allowed to delete data that we still need to retain due to legal retention periods. Also, data that we need for the assertion, exercise or defense of legal claims are excluded from your right of deletion.

You can also delete the data of your GAngel Basic membership in your profile or your profile itself. Alternatively, you can contact customer service and request the deletion of your data.

9. background location services.
Data Collection
The BeTrue app uses background location services to collect your location data. This includes GPS coordinates, Wi-Fi signals, Bluetooth signals, and other information, which we use to draw your movement path on the map. We will only collect and use the necessary location data to provide relevant services.

Data Use
The location data we collect will be used to provide map services, draw your movement path, provide personalized recommendations, analyze user behavior, and other related purposes. We will not use your location data for advertising purposes.

Data Sharing
We will not share your location data with third parties, except when necessary to comply with legal requirements or court orders, or to protect our rights or the safety of our users. We will only share location data with partners when necessary, such as map providers or logistics service providers.

User Control
You can choose to turn off background location services in the app settings. Once turned off, we will no longer collect your location data. You can also delete your location data at any time. If you need to change or delete your location data, please contact us.

Data Protection
We will take reasonable security measures to protect your location data from unauthorized access, use, or disclosure. We will use necessary technical and organizational measures to protect your location data, including using encryption technology, restricting data access permissions, and other related measures.

We may update this Privacy Policy. We will place any updates to this policy on this website. You are bound by any changes to the Privacy Policy by using GAngel services.
